On March 15, 2024, the Governor of Utah signed a bill implementing a new law in the state regulating the use and development of artificial intelligence. Here are some key things you need to know about the law.

The law adds to the state's consumer protection laws, which govern areas such as credit services, car sales and online dating. The new law states that anyone accused of violating a consumer protection law cannot blame the use of generative AI (as Air Canada apparently attempted to do in February).
The new law also states that if a person involved in any act covered by state consumer protection laws asks the company they are dealing with if they are interacting with an AI, the company must disclose that fact to clear and visible manner.
And the law states that anyone providing services as part of a regulated profession in the state (for example, an architect, surveyor, or therapist) must disclose any use of generative AI in advance. The law describes the requirements for these notifications.
In addition to addressing consumer protection, the law also establishes a plan for the state to promote innovation in the field of artificial intelligence. The new law introduces a regulatory framework for an AI learning lab to study the risks and benefits of AI and guide the regulatory development of AI.
The law discusses the conditions for participation in the program and also provides certain incentives for the development of AI technologies, including "regulatory mitigations" to adjust or relax certain regulatory requirements for participants and reduce potential liability.
This law is the first of its kind and other states will likely adopt similar laws. Much more to come on this topic.
